Terms and conditions of Popken Fashion GmbH

The Contract

The contract comes into effect once the goods have been dispatched. This takes place without further notice. We will immediately confirm your order via email once you have placed them with us. However, we reserve the right to check your order internally. In exceptional cases we cannot guarantee to send you the goods.

Delivery

Articles which are immediately available are generally delivered in 5-10 working days upon receipt of a complete and error-free order. The valid delivery times for the article of your choice are shown directly at each particular article. An so you can see at a glance when you can expect delivery. Delivery can be delayed, when there is a Sunday or bank holiday between order and delivery . In the event, that your order contains articles which are not available for delivery, the dispatch date of the order can be delayed. In order to reduce environmental damage, we will combine part orders whenever possible. This can lead to delivery delays. For articles from the Preview Collection, separate delivery times apply. These can be found in the text information on the article description page. For shipping outside the Federal Republic of Germany and within Europe, delivery time for goods which are immediately available is normally 10-14 working days.

If you prefer, we will deliver the goods to an address other than your main address. Please enter your alternate delivery address at the cash point or enter it on your order form.

Delivery Cost

The delivery cost regarding freight, packaging and insurance amounts to 16,95 €. This amount will be charged once per order, regardless of how many individual deliveries the order consists of.Delayed portions of your order are, of course, free of charge.

Should you change your place of residence, we would kindly ask you to inform us as soon as possible. All necessary personal details will be recorded by us at the time of your order and we assure you that they will be handled trustworthily.

Payment

We accept credit card payment and will be happy to process Visa & MasterCard. All prices in this catalogue are in Euros and include statutory Value Added Tax (VAT). The prices are valid until the publication of the next catalogue. The goods remain the property of Popken Fashion GmbH until payment has been fully completed.

Payment by Credit Card

We would ask you to give us your credit-card number, Security Pin Number (on the reverse side of your credit card), the issuing credit institute, expiry date and your date of birth. The debit demand will be made to your credit-card issuer as soon as the goods have left our premises. Returned goods will be immediately removed from your customer account and the corresponding credit-value transferred to your credit-card issuer.

Purchase via PayPal

You can also pay securely and easily via PayPal. At the end of the order process you will be redirected to PayPal. If you are already a PayPal customer, you can log in there with your user data and make the payment. Settlement with PayPal takes place as soon as the goods have left our premises. Returned goods will be discharged immediately upon receipt and sent to PayPal for credit on the same working day. Please note, as long as a conflict is open with Paypal, no refund can be made.

Discount Vouchers

Discount Vouchers are linked to a Minimum Order Value following returns. The redeeming of a discount voucher may be subsequently revoked if following returns the minimum order value is not reached. A discount voucher may be redeemed once only and the validity of the promotion is clearly defined. Discount vouchers are valid also for reduced articles.Are valid only for articles available and may not be combined with other promotions. A subsequent reduction with the discount voucher or a cash pay-out is not possible. Discount vouchers may not be used for the purchase of Gift Vouchers.

Right of revocation

Right of withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the last good. To exercise the right of withdrawal, you must inform us Popken Fashion GmbH, Customer Support, Am Waldrand 19, 26180 Rastede of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post, fax or e-mail). You may use the attached model withdrawal form (Download here), but it is not obligatory. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest. You shall send back the goods or hand them over to us without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired. You will have to bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
